Updated Forms
On Sept. 1, 2025, Island County District and Municipal Court updated local rules will come into effect. In order to come into compliance with CrRLJ 3.3 (setting trial dates), the court will be setting pretrial and trial dates at the arraignment hearing. LCrRLJ 3.3.1 outlines the process of setting trial dates and continuing pretrial and trial dates. To comply with CrRLJ 3.3 and ease the transition and efficiency of continuing court dates, the District Court has updated it's forms for the upcoming change.
For your convenience in continuing trial dates, the court has provided a chart outlining trial dates and the corresponding pretrial dates that are in compliance with LCrRLJ 3.3.1. Additionally, the new continuance form can be submitted by agreement in advance of the court date or presented to the court on the date of the pretrial.

Counsels (pro se litigants), we are trying to make Island County District and Municipal Court more accessible than in the past, by providing online forms. Below you will find a number of regularly used forms.
Waiver of Attendance: Under local rule LCrRLJ 3.4 amended in 2016, requires a personal appearance unless a 'waiver of attendance' is filed with the court. Below you will find a waiver of attendance. While a waiver of attendance is required, the specific form provided below is not mandated. It is being offered to assist and facilitate with compliance of the local rule.
Request for Continuance: Among the forms you will find a request for continuance. The District Court understands the difficulties of private practice and balancing the defendant's individual schedules. If you are requesting a continuance in advance of the hearing date, you may submit a motion for continuance (form provided below) in advance of the scheduled pretrial date. The court will be reviewing (or balancing) the following steps that have been complied with:
- The individual is in compliance with pretrial or post-conviction orders;
- Whether the individual is required or has been ordered to appear physically before the court;
- If there are outstanding warrants in any other jurisdictions;
- That there is an appropriate waiver of speedy trial;
- That there is either a waiver of attendance filed with the court (see: waiver of attendance below) or the defendant has actually signed or electronically signed the motion for continuance (no telephonic approval), and;
- That the request is being filed a minimum of forty-eight (48) hours prior to the hearing date. If the order is not filed prior to this time period, all parties need to appear and have the request heard on the record.

Deferred Prosecution Form: The petition and findings form have had a long overdue update. Please, look at the new forms prior to submitting your petition for a deferred prosecution. We are also attempting to assist and make the process for petitioning for a deferred prosecution easier and more efficient. When reviewing your paperwork please make sure you have the following forms and have complied with the necessary steps.
Steps (Deferred Prosecution Paperwork)
- Review and have signed the "Petition for Deferred Prosecution"
- Review and have signed the proposed "Finding of Facts and ... Order"
- Attach Exhibit Cover Sheet (with the following documents)
- Treatment Evaluation
- Signed Treatment Contract / Commitment to Provide Treatment
- Probation Report (your client will need to meet with probation prior to petitioning for DP)
- Police Reports
- Statement of Criminal History (Prosecution provided).
Once this is completed, please submit all the above forms a minimum of three (3) court days prior to the hearing date. Paperwork submitted on the day of the hearing will be set over to the following week, so the court can have adequate time to review the documentation.
